What Is Elder & Dependent Abuse?

Elder and dependent abuse (often referred to as “nursing home abuse,” though the abuse can take place in any location), involves the physical, emotional, financial, or sexual abuse of individuals who are not able to care for themselves. Nursing homes, assisted living facilities, and in-home caregivers are expected to provide a reasonable standard of care. However, in reality, this is not always the case.

According to the National Council on Aging (NCOA), statistics show that:

  • Approximately 10% of all Americans over the age of 60 have experienced some form of abuse
  • Individuals who are socially isolated or have a mental impairment, such as dementia, are at a higher risk for abuse
  • Elders who have been abused face a significantly higher risk of death—up to 300% more than those who have not been abused

Sadly, NCOA also reports that up to 60% of elder abuse is perpetrated by a family member or relative. Additionally, some studies have shown that as few as 1 in 14 instances of abuse are reported. If you are the victim of abuse yourself, or you believe that your family member or loved one is suffering abuse, reach out to our firm as soon as possible. Our Oxnard elder and dependent abuse attorneys are committed to helping you seek the justice and recovery you are owed.

Signs of Elder or Dependent Abuse

Many victims of elder or dependent abuse or unable or unwilling to speak out about the abuse that is occurring. They may even be unaware that what they are experiencing is abuse. As the family member or loved one of someone living in a nursing home or other care facility, it is important that you are able to spot the signs of potential abuse. By knowing what to look for, you can act quickly to stop the abuse and hold the responsible parties accountable.

Common signs of elder or dependent abuse include:

  • Sudden changes in mood or behavior
  • Unexplained injuries, including bruises, bed sores, and broken bones
  • Slip and fall accidents that occur in elder or dependent care facilities
  • Reluctance to see a doctor for wounds or injuries
  • Trouble sleeping or sudden loss of interest in previously enjoyed activities
  • The appearance of sexually transmitted diseases
  • Unusual and unexplained withdrawals from bank accounts
  • Changes to legal documents or documents suddenly disappearing
  • Decreased appetite or unexplained weight loss
  • Changes to prescribed medication, missed doses, or overdosing

These are just some of the signs that your loved one may be suffering elder or dependent abuse. Abuse can also take the form of neglect. In other words, if a facility fails to provide the proper level of care, it may be held responsible for any harm your loved one suffers.
